A federal appeals court in Washington, D.C., has ruled that former U.S. President Donald Trump exceeded his authority in imposing many of his controversial tariffs.
In a 7-4 decision issued on Friday, the court said U.S. law grants the president broad powers during a declared national emergency but does not explicitly authorize the imposition of tariffs, duties, or taxes.
The judges described Trump’s tariffs as “unbounded in scope, amount, and duration”, noting they asserted powers “beyond the express limitations” of the law relied upon by his administration.
The ruling delivers the most significant legal setback yet to Trump’s trade policies, which reshaped U.S. relations with major economies during his tenure.
The decision could now head to the U.S. Supreme Court to determine whether a president has the constitutional authority to unilaterally alter American trade policy.
Trump dismissed the court’s finding as politically motivated. Meanwhile, the appeals court said the decision would not take effect until October 14, allowing time for possible appeals.
